These Terms and Conditions (“Terms”) govern the relationship between Tay Medispa (“the Clinic”, “we”, “us”, or “our”) and the client (“you”, “your”, or “the patient”) regarding the provision of medical aesthetics, skin health, and wellness treatments. By booking an appointment or using our services, you agree to be bound by these Terms.

1. Professional Regulation and Safety

1.1 Tay Medispa is a multi-award-winning clinic regulated by Healthcare Improvement Scotland (HIS). We adhere to the highest standards of clinical safety and professional conduct.
1.2 All medical aesthetic treatments, including but not limited to anti-wrinkle injections and dermal fillers, are performed by qualified practitioners using MHRA and FDA-approved products from pharmaceutical brands such as Allergan, IBSA, Merz, Teoxane, and Croma.
1.3 We reserve the right to refuse treatment if, in our professional opinion, the treatment is not suitable for you or if we believe it is not in your best medical interest.

2. Appointments and Bookings

2.1 All treatments are subject to availability.
2.2 Consultations: A consultation is required for all new patients and for specific advanced treatments. During the consultation, an Observ Skin Analysis or medical assessment may be performed to determine suitability.
2.3 Deposits: To secure an appointment, we require a deposit. This deposit will be credited toward the cost of your treatment. Deposits are typically non-refundable but may be credited for future treatments if you provide at least 48 hours’ notice in line with the Cancellation Policy (Section 3).

3. Cancellation and Rescheduling Policy

3.1 We require a minimum of 48 hours’ notice to cancel or reschedule an appointment.
3.2 Failure to provide 48 hours’ notice will result in the forfeiture of your deposit.
3.3 "No-shows" (failure to attend an appointment without prior notice) will result in the loss of the deposit, and we reserve the right to require full upfront payment for any future bookings.
3.4 If you are more than 15 minutes late for your appointment, we may be unable to perform the full treatment, or we may need to reschedule. In such cases, the cancellation fee or deposit forfeiture may apply.

4. Medical Suitability and Patient Responsibility

4.1 You must complete our medical history form before treatment. It is your responsibility to provide an accurate and complete medical history, including any allergies, medications, or underlying health conditions.
4.2 You must inform us of any changes to your health or medication between appointments.
4.3 We reserve the right to refuse treatment if, in our professional opinion, it is not suitable for you or is not in your best interest.
4.4 Tay Medispa cannot be held liable for any adverse reactions or consequences resulting from your failure to disclose relevant medical information.
4.5 Patients must be at least 18 years of age for all aesthetic and medical treatments, particularly injectable treatments. We reserve the right to request valid photo identification.

5. Treatment Results and Aftercare

5.1 While we use evidence-based techniques and medical-grade products, individual results vary from person to person. No guarantee is made regarding the exact outcome of any treatment.
5.2 Aftercare instructions will be provided following your treatment. Failure to strictly follow these instructions may compromise your results and increase the risk of complications. Tay Medispa is not liable for outcomes resulting from poor aftercare compliance.

6. Pricing and Payment

6.1 Prices for treatments and products are subject to change. The price confirmed at the time of booking will be honored for that specific appointment.
6.2 Full payment is required at the time of treatment, minus any deposit already paid. We accept major credit/debit cards and other approved payment methods.
6.3 Treatment courses (e.g., HydraFacial courses or IPL packages) must be paid for in advance and are valid for a period of 12 months from the date of purchase.

7. Product Sales and Returns

7.1 Due to the medical-grade nature of our skincare products (including ZO Skin Health), we cannot accept returns for opened or used products for hygiene and safety reasons.
7.2 If a product is found to be faulty, it must be returned within 14 days of purchase for an exchange or refund.

8. Liability

8.1 Tay Medispa’s liability for any loss or damage is limited to the total cost of the treatment provided, except in cases of personal injury or death caused by our negligence.
8.2 We are not liable for any indirect or consequential loss, or for loss of earnings resulting from any treatment complications or appointment rescheduling.

9. Privacy and Data Protection

9.1 We process your personal and medical data in accordance with our Privacy Policy and the Data Protection Act 2018 (GDPR).
9.2 Medical records and "before and after" photographs are stored securely. Photographs will only be used for marketing purposes with your explicit written consent.

10. Complaints Procedure

10.1 We are committed to providing excellent care. If you are dissatisfied with your experience, please contact us at info@taymedispa.co.uk.
10.2 As a HIS-regulated clinic, we maintain a formal complaints policy. If we are unable to resolve your complaint internally, you have the right to escalate the matter to Healthcare Improvement Scotland.

11. Governing Law

11.1 These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
